Dimensions and Values for Reasoning with Legal Cases

چکیده

In this paper we build on two recent attempts to formalise reasoning with dimensions. Both of these approaches effectively map dimensions into factors, which enables propositional reasoning, but we show that sometimes a balance between dimensions needs to be struck. To permit trade offs we need to keep the magnitudes and reason more geometrically. We also revisit the link between dimensions and values, showing that values play a number of distinct roles, not only explaining preferences between factors, but also ensuring that all the purposes of the underlying law are considered.

Dimensions and Values for Legal CBR

We build on two recent attempts to formalise reasoning with dimensions which effectively map dimensions into factors. These enable propositional reasoning, but sometimes a balance between dimensions needs to be struck, and to permit trade offs we need to keep the magnitudes and so reason more geometrically. We discuss dimensions and values, arguing that values can play several distinct roles, b...

Argumentation Corner A formalization of argumentation schemes for legal case-based reasoning in ASPIC+

In this article we offer a formal account of reasoning with legal cases in terms of argumentation schemes. These schemes, and undercutting attacks associated with them, are formalized as defeasible rules of inference within the ASPIC+ framework. We begin by modelling the style of reasoning with cases developed by Aleven and Ashley in the CATO project, which describes cases using factors, and th...

Arguing with Dimensions in Legal Cases

In this short paper we introduce some novel arguments based on legal cases represented as sets of dimensions. Although there has been much work on arguments based on factors, there has been relatively little recent work which has exploited dimensional representations. The arguments that we consider have a flavour quite distinct from those generated from cases represented as factors, which lack ...

Argumentation Schemes for Reasoning about Factors with Dimensions

In previous work we presented argumentation schemes to capture the CATO and value based theory construction approaches to reasoning with legal cases with factors. We formalised the schemes with ASPIC+, a formal representation of instantiated argumentation. In ASPIC+ the premises of a scheme may either be a factor provided in a knowledge base or established using a further argumentation scheme. ...
